This User Agreement ("Agreement") governs the use of Jingle & Wear ("we", "our", "us") website and services, where Cash on Delivery (COD) is the sole payment method. By placing an order, you ("you", "user", "customer") acknowledge reading, understanding, and agreeing to these terms.

1. Acceptance of Terms

By accessing our website, browsing products, or submitting an order, you confirm compliance with this Agreement and our Privacy Policy. We reserve the right to update these terms; changes will be posted on the website and take effect immediately upon publication. Your continued use after updates constitutes acceptance.

2. Orders & Eligibility

2.1 Order Placement

You must provide accurate, complete information (full name, valid delivery address, active phone number) when ordering. We may verify details before processing. Orders are not confirmed until you receive an email with the order number .

2.2 Order Limitations

We reserve the right to accept or decline orders (e.g., for out-of-stock items, incorrect addresses, or suspicious activity). "Pre-order" items will be marked explicitly, with estimated delivery timelines .

2.3 Eligibility

You must be at least 18 years old or have parental/guardian consent to place orders.

3. Cash on Delivery (COD) Terms

3.1 Payment Obligation

You agree to pay the full amount (product price + applicable taxes + shipping fees) upon delivery. We accept cash or major credit/debit cards (Visa, Mastercard) via the delivery driver’s encrypted reader .

3.2 Inspection & Payment

You have the right to inspect goods before payment to verify:

  • Correct item(s) and quantity
  • No visible damage or defects
  • Compliance with product descriptions If unsatisfied, you may refuse delivery without payment. Drivers will not accept partial payments for split orders.
3.3 Payment Logistics
  • Drivers carry change for cash payments up to $20; exact amounts are appreciated.
  • Card payments are processed on-site via secure, encrypted terminals—no card data is stored by us .
  • Failure to pay at delivery will result in order return. A second delivery attempt is free; subsequent attempts incur a $10 fee.

4. Products & Inspection

4.1 Product Information

We strive for accurate product descriptions (materials, sizes, designs) as detailed in the "descriptions" section of each listing. Sizes follow US standards; refer to product size charts for fit guidance .

4.2 Inspection Requirements
  • On-Site Inspection: Check packaging integrity and item condition in the driver’s presence.
  • Defect Notification: If issues are found after delivery (e.g., hidden defects), notify us via email within 24 hours with photos/videos for verification .
  • No Functional Testing: For hygiene and safety, try-on (e.g., sweaters, costumes) is allowed, but functional testing of accessories (e.g., jingle bells) is limited to visual checks.

5. Returns & Refunds

5.1 Return Eligibility

Returns are accepted within 30 days of delivery if:

  • Items are unused, unwashed, and in original packaging
  • Tags and labels remain intact
  • Defects are not caused by improper use
5.2 Refund Process

Request a return by emailing Kimberly86470@gmail.com with your order ID and defect photos.

We will provide a free return label within 2 business days.

Refunds are processed 5-7 days after we receive and inspect the returned item:

  • Cash payments: Refunded via cash (arranged via local courier)
  • Card payments: Refunded to the original card
5.3 Non-Refundable Items

Customized products, pet attire with visible wear, and items without original packaging are ineligible for refunds.

6. Delivery & Risk

6.1 Delivery Details

We ship to eligible regions (listed at checkout). Standard delivery takes 3-7 business days; tracking updates are sent via email .

6.2 Risk Transfer

Title and risk of loss pass to you upon acceptance and payment of the order. We are not liable for damage or loss during delivery unless caused by our shipping partner’s negligence.

7. Privacy & Data Use

We collect only necessary information (name, address, phone, email) to process orders and deliver goods. Your data is used exclusively for order fulfillment and is not shared with third parties except our delivery partners . We delete your data 6 months after order completion (see our Privacy Policy for details).

8. Limitation of Liability

We are not liable for:

  • Delays due to weather, logistics disruptions, or incorrect address provided by you
  • Minor color/size variations from product images (due to lighting/display differences)
  • Indirect losses (e.g., missed events, inconvenience) from order issues Our total liability for any claim shall not exceed the total order value.

Liability for Breach

  • Your Breach: Failure to pay at delivery may result in order cancellation and restriction from future purchases. Repeated refused deliveries incur a $15 restocking fee.
  • Our Breach: If we deliver incorrect/damaged items, we will replace them free of charge or issue a full refund. Late delivery (over 10 days) entitles you to a 10% order value discount .

10. Governing Law & Disputes

This Agreement is governed by the laws of [insert your operating region, e.g., the State of California, USA]. Disputes shall first be resolved via friendly negotiation. If unresolved, either party may pursue remedies through arbitration or courts in the governing region .

11. Miscellaneous

  • This Agreement constitutes the entire understanding between you and Jingle & Wear, superseding prior oral/written agreements.
  • If any clause is deemed unenforceable, the remaining terms remain valid.
